These Terms & Conditions (“Terms”) govern access to and use of PharmaAdda (the “Platform”), owned and operated by WebHopers Infotech PVT. LTD. (“Company”, “we”, “us”, “our”), a company/proprietorship registered under the laws of India with its registered office at 3rd Floor, Showroom NO. A-303, A-304, TOWN-A, AK Trade Center Zirakpur, Ambala Chandigarh Road, Mohali, Zirakpur, Punjab 140603. By registering on, accessing, or using the Platform, you (“User”, “you”) agree to be bound by these Terms. If you do not agree, do not use the Platform.
2.1 The Platform is a business directory and lead-generation marketplace connecting Manufacturers/Sellers with Buyers in the pharmaceutical, ayurvedic, nutraceutical, cosmetic, and allied sectors.
2.2 The Company is an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. The Company does not manufacture, sell, stock, distribute, market, or take title to any drug, cosmetic, or medicine listed on the Platform, and is not a party to any transaction, agreement, franchise arrangement, or sale negotiated between a Manufacturer/Seller and a Buyer.
2.3 All negotiations, contracts, pricing, quality assurance, supply, payment, and after-sales terms are strictly between the Manufacturer/Seller and the Buyer. The Company bears no responsibility for the performance, non-performance, or breach of any such arrangement.
Listings are created and maintained by Manufacturers/Sellers themselves. The Company does not verify, endorse, or guarantee the accuracy, quality, legality, or regulatory compliance of any Listing, product, price, or claim. The Platform is provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied.
Certain features (e.g., premium listings, verified badges, featured placement) may be offered on a paid subscription basis, as communicated separately at the time of purchase. Fees, once paid, are non-refundable except as required by law or as expressly stated in the applicable service plan.
The Platform’s design, logo, software, and proprietary content belong to the Company. Users retain ownership of Content they upload but grant the Company a non-exclusive, royalty-free, worldwide license to host, display, and distribute such Content for the purpose of operating the Platform.
To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, or consequential loss arising from: (a) any transaction, dispute, or breach between a Manufacturer/Seller and a Buyer; (b) inaccuracy of any Listing or Content; (c) any regulatory action arising from a User’s non-compliance with applicable law; or (d) downtime, data loss, or unauthorized access despite reasonable security measures.
Users agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claim, loss, or liability arising from their Listings, Content, breach of these Terms, or violation of applicable law, including the Drugs and Cosmetics Act, 1940.
The Company may suspend or terminate any account, without prior notice, for violation of these Terms, listing of unlicensed/banned products, fraudulent activity, or on receipt of a valid regulatory or law-enforcement directive.
In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, grievances or complaints regarding Content on the Platform may be addressed to:

The Grievance Officer shall acknowledge complaints within 72 hours and resolve them within the timelines prescribed under applicable law.
These Terms shall be governed by the laws of India. Subject to Clause 15, the courts at Mohali (S.A.S. Nagar), Punjab shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
Any dispute shall first be attempted to be resolved through good-faith negotiation within 30 days. Failing resolution, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by the Company, seat and venue of arbitration at Mohali, Punjab, and proceedings conducted in English.
The Company may revise these Terms at any time by posting the updated version on the Platform. Continued use after such changes constitutes acceptance of the revised Terms.
If any provision of these Terms is held invalid, the remainder shall continue in full force. These Terms constitute the entire agreement between the User and the Company regarding use of the Platform. The Company shall not be liable for delay or failure caused by events beyond its reasonable control (force majeure).
